Petition For Preliminary and Permanant Injunction and Civil Penalties

Missouri Attorney's General Jay Nixon, filed the lawsuit in Carthage, Jasper County Missouri yesterday, January 11, 2006. Mr. Nixon is asking the Jasper County Circuit Court to order Renewable Environmental Solutions LLC (RES) to pay penalties for the violations at its Carthage facility. This is the second lawsuit that Mr. Nixon has filed agains RES concerning odor problems. In April 2005, his office and the City of Carthage, jointly filed a lawsuit against RES, asking the Court to declare the odors a public nuisance.

Mr. Nixon said that "The referral last week from the Missouri Department of Natural Resources (MDNR) now enables us to seek penalties for a long history of odors from this plant. This was another tool we needed to bring this facility into compliance and give relief to the citizens of Carthage." Mr. Nixon is asking the Court to issue injunctions against RES to ensure that the company immediately takes any and all steps to come into compliance with Missouri air polution laws and regulations. The lawsuit also asks the Court to order RES to pay the maximum penalty for violations of its permit and of state odor regulations. so sensitivenose,the first thing i need to tell you i am not a blogger,or whatever you folks call yourselves.i am a citizen of carthage that is tired of being held hostage by a group of countries that control the world oil market.the control these countries have seems to dictate how we live our lives.just look at the way folks in jasper county acted when gas was pushing $3.00 a gallon.crazy!
okay moving forward.we have the land fill at lamar and the one at neosho that are producing methane.gas that can be turned into electric.the farmers of jasper and barton county that are producing corn for ethanol production.the same farmers are raising soybeans for biodiesel.all good things for america.
along comes RES with a way to turn turkey waste into fuel.a perfected science,probably not.are they working on the problems,i think yes.from what i have seen and heard the folks at RES want to be odor free.as cathage citizens dont we owe it to a company that has invested untold dollars and years of research to making the united states free from forigen oil a chance?i work in carthage and have smelled the odors.RES tells us they are trying to get a handle on them.i believe they are trying.i really do.lets give them a chance to show us.
and for your earlier comments on how carthage never smelled before,they dont hold up.i am 41 years old and have lived here all my life.i remember going to work in 1984 and stopping at the donut shop on central,you know the one across from what is now the jasper county health clinic and the stench from butterball was so bad we couldnt eat our breakfast.its amazing how ones memories fade,or maybe you havent lived here all that long.this town has always had odors.if you have lived here, you know that.
if you dont mind paying $3.49 for diesel,or $1.99 a gallon for propane, i can live with your gripes.when the fuel prices start putting the squeeze on you dont come crying to the folks that support recycling.cause i am afraid we wont be able to hear you,because we are to busy pushing ahead...........and looking for ways to satisfy the whiners.
